Garlic - Terms of Service

Welcome to Garlic!

These Terms of Service (“Terms”) govern your use of the Garlic mobile application (“App,” “Service,” or “Garlic”), developed and operated by an independent developer (“we,” “us,” or “our”). By downloading, installing, or using Garlic, you agree to be bound by these Terms.

Please read these Terms carefully before using the App. If you do not agree to these Terms, do not use Garlic.

1. Description of Service

Garlic is a recipe organization app that allows you to:

  • Import recipes from social media platforms (TikTok, Instagram, YouTube), websites, and photos using AI-powered extraction
  • Organize recipes into collections and filter by various criteria
  • Create shopping lists with automatic ingredient merging
  • Search recipes by ingredients you have on hand (“What’s in My Kitchen”)
  • Cook hands-free with large text display, screen wake lock, and Siri voice commands
  • Filter by dietary preferences including allergens and dietary restrictions

2. Eligibility

2.1 Age Requirements

You must be at least 13 years old to use Garlic. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use Garlic with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

2.2 Account Requirements

Garlic does not require account creation. The App uses your device’s local storage and, if enabled, Apple’s iCloud service for data synchronization across your devices. By using iCloud features, you agree to Apple’s terms and conditions.

3. Subscription and Payments

3.1 Free Tier

Garlic offers a free tier with limited functionality:

  • Limited number of recipe imports
  • Access to all core features (organizing, shopping lists, cooking mode, ingredient search)

3.2 Premium Subscription

Garlic Premium (“Premium”) provides unlimited recipe imports and is available through the following subscription options:

  • Weekly subscription
  • Annual subscription

Subscription prices are displayed in the App and may vary by region.

3.3 Free Trial

We may offer a free trial period for Premium. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

3.4 Billing

  • All purchases are processed through Apple’s App Store
  • Payment is charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions in your Apple ID account settings

3.5 Refunds

Refunds are handled by Apple in accordance with their refund policies. We do not have the ability to process refunds directly. To request a refund, please contact Apple Support or visit reportaproblem.apple.com.

4. User Content and Conduct

4.1 Your Content

“User Content” includes recipes you import, shopping lists you create, preferences you set, and any other data you input into the App.

You retain ownership of your User Content. By using Garlic, you grant us a limited license to process your User Content solely for the purpose of providing the Service (e.g., sending URLs or images to our AI service for recipe extraction).

4.2 Content You Import

When you import recipes from third-party sources (websites, social media), you acknowledge that:

  • The original content remains the intellectual property of its respective owners
  • You are importing content for personal, non-commercial use only
  • We do not claim ownership of third-party content
  • We are not responsible for the accuracy, legality, or appropriateness of third-party content

4.3 Acceptable Use

You agree NOT to:

  • Use the App for any illegal purpose
  • Attempt to circumvent subscription limits or access Premium features without payment
  • Reverse engineer, decompile, or disassemble the App
  • Use the App to infringe on others’ intellectual property rights
  • Interfere with or disrupt the App’s functionality or servers
  • Use automated means to access the App (bots, scrapers) beyond normal use
  • Resell, redistribute, or commercially exploit the App or its content

4.4 AI-Generated Content

Recipe extraction uses artificial intelligence and may not always be accurate. You are responsible for:

  • Reviewing imported recipes for accuracy
  • Verifying ingredient quantities and cooking instructions
  • Checking for allergens and dietary compliance before cooking

We do not guarantee the accuracy of AI-extracted recipes.

5. Intellectual Property

5.1 Our Property

The App, including its design, features, code, graphics, and branding (excluding User Content and third-party content), is owned by us and protected by intellectual property laws. The Garlic name, logo, and associated branding are our trademarks.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

5.3 Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us the right to use such feedback without compensation or attribution to you.

6. Third-Party Services

6.1 Services We Use

Garlic integrates with the following third-party services:

  • Apple iCloud/CloudKit: For data synchronization across your devices
  • Google AI Services: For AI-powered recipe extraction and analysis
  • RevenueCat: For subscription management
  • Social Media Platforms (TikTok, Instagram, YouTube): For content extraction when you provide URLs

6.2 Third-Party Terms

Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

6.3 Links to Third-Party Content

The App may contain links to original recipe sources. We are not responsible for the content, accuracy, or practices of linked websites.

7. Health and Safety Disclaimers

7.1 Dietary and Allergen Information

Garlic provides dietary filtering and allergen labeling features. However:

  • We do not guarantee the accuracy of allergen or nutritional information
  • Dietary filters are based on AI analysis and may contain errors
  • Always verify ingredients if you have food allergies, intolerances, or dietary restrictions
  • Consult a healthcare professional for medical dietary advice

7.2 Cooking Safety

  • Follow standard food safety practices
  • We are not responsible for injuries, illness, or damages resulting from recipe preparation
  • Timer features are provided as a convenience; always use your own judgment for cooking times

7.3 No Medical Advice

Nothing in the App constitutes medical, nutritional, or health advice. Always consult qualified professionals for dietary and health concerns.

8. Disclaimers and Limitation of Liability

8.1 “As Is” Service

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of content
  • Uninterrupted or error-free operation

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or goodwill
  • Personal injury or property damage related to your use of the App
  • Any damages exceeding the amount you paid us in the 12 months preceding the claim

8.3 Jurisdictional Variations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify and hold harmless the developer of Garlic from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content

10. Termination

10.1 By You

You may stop using Garlic at any time by deleting the App from your device. To cancel a subscription, you must do so through your Apple ID account settings.

10.2 By Us

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Reasons for termination may include violation of these Terms or abusive behavior.

10.3 Effect of Termination

Upon termination:

  • Your license to use the App ends
  • We have no obligation to retain your data
  • Provisions that by their nature should survive (such as intellectual property, disclaimers, and limitations of liability) will continue to apply

11. Changes to the Service and Terms

11.1 Changes to the App

We may modify, suspend, or discontinue the App or any features at any time without notice. We are not liable for any modification, suspension, or discontinuation of the App.

11.2 Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by other means. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law and Disputes

12.1 Governing Law

These Terms are governed by the laws of Indonesia, without regard to conflict of law principles.

12.2 Dispute Resolution

Before initiating any legal action, you agree to contact us first and attempt to resolve any dispute informally. Most concerns can be resolved quickly through email correspondence.

If we cannot resolve a dispute informally, any legal proceedings shall be brought in the courts located in Indonesia, and you consent to the jurisdiction of such courts.

12.3 Class Action Waiver

To the extent permitted by law, you agree to resolve disputes individually and waive the right to participate in class action lawsuits or class-wide arbitration.

13. General Provisions

13.1 Entire Agreement

These Terms constitute the entire agreement between you and us regarding the App and supersede any prior agreements.

13.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

13.3 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.

13.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction.

15. Apple-Specific Terms

As required by Apple, you acknowledge and agree that:

  • These Terms are between you and the developer of Garlic, not Apple
  • The developer of Garlic, not Apple, is solely responsible for the App and its content
  • Apple has no obligation to provide maintenance or support for the App
  • Apple is not responsible for any product warranties, whether express or implied
  • The developer of Garlic, not Apple, is responsible for addressing any claims related to the App
  • Apple is not responsible for investigating, defending, or settling any third-party intellectual property claims
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you

By using Garlic, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
